These Terms and Conditions apply to the $30,000 Study Grant – CSU Online Competition ("Promotion"), part of the major CSU Online campaign.
Information on how to enter and details on the major prize forms part of these Terms and Conditions.
The promoter is Charles Sturt University (ABN 83 878 708 551) and its agents and contractors ("CSU").
Entry is only open to individuals who are legally entitled to reside in Australia during the Promotion, including Australian residents and foreign students with appropriate student visa ("entrants"). Employees of CSU and agencies associated with the Promotion and the immediate family members of these people are ineligible to enter or vote.
"You" means you as an entrant in the Promotion.
The Promotion commences 12.01am AEST on 05.01.2016 and ends at 11.59pm AEST on 29.2.2016 ("Entry Period").
Entry into the Promotion constitutes acceptance of these Terms and Conditions.
Only entries that comply with these Terms and Conditions will be deemed a 'valid entry'. Any entry that does not comply with these Terms and Conditions will be deemed an 'invalid entry' and will not be published for public view on the Promotion website.
Entries will be moderated and only approved entries will be published for public view on the Promotion website.
To submit an entry in the Promotion, you must do so during the Entry Period, by visiting the Promotion website, completing and submitting the online entry form, including all mandatory information. Any images must be in a format as determined by CSU in its absolute discretion.
When you submit any materials via the Promotion including videos and images and text ("Content"), you, unless CSU advises otherwise, license and grant CSU, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use. You warrant that you have the full authority to grant these rights.
Entrants agree that they are fully responsible for the Content they submit. CSU shall not be liable in any way for such Content to the full extent permitted by law. CSU may remove any Content that it may display without notice for any reason whatsoever.
You warrant and agree that: (a) you will not submit any Content that is unlawful or fraudulent, or that CSU may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children under the age of 15, or otherwise unsuitable for publication; (b) you will obtain prior consent from any person or property that appears in your Content; (c) you must only submit Content which you have personally created; (d) your Content shall not contain viruses or cause injury or harm to any person or entity; and (e) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
You indemnify CSU against any claims that result from breaching Clause 13. CSU reserves the right to deem any entry 'invalid' where it reasonably suspects the entry have not complied with Clause 13. This is at CSU's absolute discretion and discussions will not be entered into.
Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; (b) the same entry cannot be entered more than once; (c) each entry must be submitted separately and in accordance with these Terms and Conditions.
A panel of judges appointed by CSU will judge each of the valid entries submitted according to originality and creative merit.
The best entry, as determined by the judges, will be declared the winner and win the 'Major Prize' ("Winner").
The judging panel's decision is final and no correspondence will be entered into.
The Winner will be announced within 10 days of the close of the Promotion.
The 'Major Prize' will consist of a maximum $30,000 Study Grant at CSU ("Study Grant"). The Winner must enrol at CSU within 12 months of the announcement of the Winner in the minimum number of subjects to complete a full degree ("Degree"). The Degree can be either Undergraduate or Postgraduate. This Degree must be undertaken through CSU Online.
The Winner's enrolment at CSU in the Degree is subject to CSU's admission requirements for entry into the Degree. If the Winner does not comply with CSU's admission requirements and is not accepted by CSU into the Degree, CSU will terminate the Study Grant to the Winner and, in its absolute discretion, the Study Grant will be awarded to another entrant in accordance with these Terms and Conditions at Clauses 16- 18 and CSU will make the announcement of the alternative winner as soon as practicable.
The value of the Study Grant will be averaged out and paid annually to the Winner over the time required to complete the Degree. The annual payment will be made following the census dates for enrolments each year of the tenure of the Degree.
The Study Grant is subject to the Winner maintaining satisfactory academic progress and a continued enrolment in the Degree. If these conditions are not met, this Study Grant may be terminated by CSU in its absolute discretion.
If the Winner fails to maintain satisfactory academic progress in the Degree and is subsequently suspended or excluded from the Degree by CSU, CSU will cease paying the remainder of the Study Grant to the Winner. If the exclusion is one year or less ("Exclusion Period"), and the Winner resumes their studies in the Degree promptly following expiry of the Exclusion Period, the Study Grant may be reinstated.
If the Winner is suspended or excluded from the Degree by CSU for more than one year, or the Winner withdraws or cancels their enrolment from their Degree or the Winner fails to maintain satisfactory grades in the Degree over a prolonged period, or the Winner transfers from CSU to another university or place of study, CSU will, in its absolute discretion, cease paying the remainder of the Study Grant to the Winner.
If the Winner is granted an Approved Leave of Absence from their Degree, they may request that the Study Grant be placed on hold until they return to study. This request must be made in writing stating the expected date of return to study. The decision to allow this Study Grant to be placed on hold is entirely at the discretion of CSU. It will only be placed on hold for a period no longer than 12 months. If the Winner does not return to study after this time in the Degree, the Study Grant will be terminated. Following re-enrolment, the Winner must advise of their return to study to re-activate this Study Grant.
If CSU ceases paying the remainder of the Study Grant to the Winner pursuant to these Terms and Conditions, CSU will not require the Winner to repay any part of the Study Grant already paid to the Winner.
If you are the Winner of the Study Grant, you acknowledge and agree: (a) that you will be available for any and all publicity requirements from CSU regarding the Promotion for the duration of your studies with CSU and (b) all such publicity remains the property of CSU.
If required by CSU, it is a condition of receiving the Study Grant that the Winner must sign a Deed of Participation, Assignment, Release and Indemnity ("the Deed"), in a form determined by CSU. If the Winner refuses to sign the Deed, then they will forfeit the Study Grant and it will be offered to another entrant, as determined by CSU.
CSU reserves the right, at any time, to disqualify you or any other entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry or voting process. Failure by CSU to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
If any prize (or part of any prize) is unavailable, CSU, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
Prizes, or any unused portion of a prize, are not transferable or exchangeable.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of CSU, CSU reserves the right, in its sole discretion, to the fullest extent permitted by law to: (a) disqualify you or any other entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
CSU accepts no responsibility for late, lost or misdirected entries. Entries will be deemed void if fraudulent.
Any cost associated with accessing the Promotion website is the entrant's responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, CSU (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under CSU's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by CSU) due to any reason beyond the reasonable control of CSU; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) in connection with receiving a prize.
CSU collects your personal information in order to conduct the Promotion and to enable CSU to make you more aware of CSU. For these purposes CSU may disclose such information to third parties, including, but not limited to, other entrants to tell them who has entered or won the Promotion, prize suppliers and if required, to Australian regulatory authorities.
You will not be able to enter in the Promotion unless you give CSU the personal information the Promoter requests.
During the period of the Promotion, unless you tell CSU not to, CSU will use the information to promote, market and publicise CSU to entrants and to tell them how the Promotion is progressing. To do this, CSU may send you email messages. After the Promotion, unless you tell CSU not to, CSU may also use your personal information to contact you about other offers.
